This AGREEMENT, made by and between “Let's Go OC” (the Let's Go OC) and (the Client), on this 2017, sets forth the terms and conditions under which the Client retains, and the Let's Go OC provides, services related to travel to, from, and in United State of America.

1. GROUP SIZE AND COSTS
The Let's Go OC will accommodate groups of ten (10) Clients or more. All tour packages are priced for groups composed of ten (10) Clients. Smaller groups of Clients may incur increased costs. The Let's Go OC will explain such costs to the Clients well in advance of the tour. Airline and train tickets are non-refundable. If individual Clients cancel, and a smaller group of Clients still desire to travel together, that group will incur additional costs to be explained to the Clients well in advance of the tour.

2. ACCOMODATIONS
(a) Hotels – The Let's Go OC will select the hotel(s) for the tour. Prior to the departure, the Let's Go OC will provide the Client with the hotel information, including the name, location, and telephone number of the hotel. In advance of the tour, the Client will inform the Let's Go OC whether he or she prefers a shared room or a single room. If the client prefers to share a room with another tour member, the Let's Go OC will use its best efforts to make a compatible shared room assignment for the Client.

The Client shall inform the Let's Go OC if the Client has any special needs, including a smoking or non-smoking room. If the Client expresses no preference within a reasonable time before the tour, the Let's Go OC will assign the Client to either a shared or a single room at Let's Go OC’ discretion. If a single room is assigned to the Client for any reason, including, but not limited to, a roommate’s cancellation and incompatibility (even during the tour), the Client will be responsible for the cost of the single room.

(b) Travel – the Let's Go OC will select and make air and ground transportation arrangements for the Client. Upon request from the Client, the Let's Go OC will provide the Client with detailed information about the travel arrangements.

3. SUBSTITUTIONS
The Let's Go OC, in it's discretion, may substitute portions of the tour, including, but not limited to, sightseeing, hotels, and restaurants, prior to, and during, the tour. The Let's Go OC will fully explain such substitutions to the Client as such substitutions become known to the Let's Go OC.

4. HOLIDAYS AND CHANGES
During local or national holidays, some facilities, such as museums and shops, may close or operate on limited schedules. On such occasions, the Let's Go OC may make itinerary adjustments to minimize inconvenience to the Client. The Let's Go OC will inform the Client well in advance of the departure date if any such adjustments need to be made.

5. TRAVEL DOCUMENTS
If the Client is a not a United States citizen, the Client will be required to present a valid passport with unexpired U.S. VISA upon entry to, and departure from USA. Clients are responsible for obtaining any required visas

6. AIRLINE RULES & REGULATIONS
a) Ticket changes may incur penalties and/or increased fares.
b) Tickets are nontransferable and name changes are not allowed.
c) Prices do not include baggage fees or other fees charged directly by the airline.
d) Other penalties may apply.
e) Rules and restrictions are imposed by the airlines and are subject to change.

7. BAGGAGE & INSURANCE
Please note that fees for your flight are determined by the airline you check in with and may change at any time. Airlines may charge extra fees for checked luggage exceeding size limits. Airlines may also apply additional charges for baggage over the weight limit, currently 50 lbs. per checked item for most U.S.-based carriers. The Client is solely responsible for complying with baggage restrictions and paying any fees imposed for noncompliance. The Let's Go OC encourages the Client to contact the airline regarding size and weight restrictions in advance of the tour. The Let's Go OC is not responsible for any damage to, or loss of, the Client’s luggage.

8. NOTICE OF BAGGAGE LIABILITY LIMITATIONS
Liability for loss, delay, or damage to baggage is limited unless a higher value is declared in advance and additional charges are paid. Excess valuation may be declared on certain types of articles. Some carriers assume no liability for fragile, valuable or perishable articles. Further information may be obtained from the carrier.

9. HEALTH AND TRAVEL INSURANCE
The Let's Go OC strongly encourages the Client to carry Travel Insurance for the tour. The Let's Go OC warns the Client that insurance carriers require travelers to purchase policies within a limited period of time from payment of the first deposit. The Client will be solely responsible for arranging insurance, and the Let's Go OC will not be liable for any damages or deficiencies in the Client’s insurance coverage.

10. MEDICATION AND MEDICAL NEEDS
The Client is responsible for bringing and/or purchasing any needed medical supplies. The Client should bring supplies for a minimum of ten (10) days. The Let's Go OC is not responsible for the purchase of any Client medications.

11. PRICES & PAYMENTS
(a) Final Payment: Payment of the balance of the price for any tour is due 15 days before the departure date of the first tout to depart. If full payment is not received by such due date, the Let's Go OC may change the rate payable for the tour, or may treat the booking of such tour as cancelled and shall retain the deposit paid on booking as a cancellation fee, at Let's Go OC’ sole discretion. If a tour is booked less than 15 days before the departure date of the first tour to depart then the full amount is payable at the time of booking in order for the booking to be confirmed.
(b) All prices are subject to change due to any change in Let's Go OC costs, including, but not limited to, changes in the number of group members, fuel costs, and currency fluctuations. The Let's Go OC will disclose any change in the amount of the Full Payment well in advance of the date such payment is due.

(c) Credit Card Charges: Let's Go OC is not responsible for any charges levied or charged by third parties and/or financial institutions and payable by the Client as a result of credit card or other payment transactions in connection with the purchase of tour and will not refund or return any fees charged by such third parties in connection with payments made by Clients to the Let's Go OC.

12. REFUND POLICY
(a) Cancellation by the Let's Go OC – Except as otherwise provided herein, in the event that the Let's Go OC must cancel a tour, the Let's Go OC will give the Client a full refund of all payments the Client has made.

(b) Cancellation Due to War or Natural Disaster – In the event that the tour must be cancelled due to war or natural disaster in US and/or its vicinity, the Let's Go OC will refund all payments the Client has made, except the costs of any nonrefundable hotel, air, or ground transportation tickets already purchased by the Let's Go OC for the Client.

(c) Let's Go OC is not responsible for any incidental expenses or consequential losses that the Client may have incurred as a result of the cancelled booking such as visas, vaccinations, non-refundable flights or rail, non refundable car or other fees, loss of earnings, or loss of enjoyment, etc.

(d) Where after departure a significant element of the tour(s) as described cannot be provided, Let's Go OC will make suitable alternative arrangements for the continuation of the trip product(s). If it is not possible to provide a suitable alternative or the Client reasonably rejects any suitable alternatives, Let's Go OC will provide the Client a refund of unused tour portions.

13. CANCELLATION BY THE CLIENT
Any cancellation of a booking and/or a tour by a Client must be delivered to Let's Go OC in writing and be acknowledged by Let's Go OC in writing. The applicable cancellation fees shall be determined with reference to the date on which the request to cancel is received by Let's Go OC or its Agents and are expressed hereinafter as a percentage of the total price paid for the cancelled tour.

(a) Cancellation received 41 days or more before departure of tour: Client will get a FULL REFUND of the payments made by the Client to Let's Go OC in respect of the cancelled tour. Client will be responsible for any penalties resulting from flight changes or flight cancellations made at your request after your flights are ticketed

(b) Cancellation received 40-15 days before departure of tour: $250.00 cancelation fee, plus the costs of any nonrefundable hotel, air or ground transportation tickets already purchased by the Let's Go OC for the Client. Client will be responsible for any penalties resulting from flight changes or flight cancellations made at your request after your flights are ticketed

(c) Cancellation 14 days and less before departure of tour: 100% of Client’s total tour cost is NOT refundable and no further refund shall be payable to the Client. Client will be responsible for any penalties resulting from flight changes or flight cancellations made at your request after your flights are ticketed

14. WAIVER
If, due to weather, flight schedule changes / cancellations or other uncontrollable factors, the Client is required to spend any additional night(s) en route to, or from, the Client’s gateway city, the Client will be responsible for his or her own hotel, transfers, meals, and other costs.

The Let's Go OC does not own or operate the entities that provide goods and services during the tour. This includes, but, is not limited to, lodging facilities, airline, guide services (from third party organizations), train, or other transport companies. All such entities are independent organizations. The Let's Go OC is not liable for any negligent or willful act or failure to act of any such person or entity, or of any third party.

In addition and without limitation, the Let's Go OC is not responsible for any injury, loss, death, inconvenience, delay, or damage to person or property in connection with the provision of any goods or services, whether resulting from, but not limited to, acts of God, illness, disease, acts of war or civil unrest, insurrection or revolt, animals, third party (including Client) negligence, recklessness, or intentional misconduct, strikes or other labor activities, criminal or terrorist activities of any kind, mechanical or other failure of airplanes or other means of transportation, or for any failure of any transportation mechanism to arrive or depart on time.

15. ACCEPTANCE OF RISK
You acknowledge that the nature of the trip is adventurous and participation involves a degree of personal risk. It is your own responsibility to acquaint yourself with all possible relevant travel information and the nature of your itinerary. You acknowledges that your decision to travel is made in light of consideration of this information and you accept that you assume the personal risks attendant upon such travel.

16. ERRORS & OMISSIONS
Although we have made a concerted attempt to verify the accuracy of statements made in our trip documentation including brochure, website and Trip Notes we cannot be held responsible for any error, omission or unintentional misrepresentation that may occur.

17. PHOTOS, VIDEO AND MARKETING
You consent to us using images of you taken during the trip for advertising and promotional purposes in any medium we choose. You grant us a perpetual, royalty-free, worldwide, irrevocable license to use such images for publicity and promotional purposes.

18. GUARANTEE
The Let's Go OC’ goal is to provide a unique, enjoyable, personal travel experience for each Client. However, if, after the Client has returned to the Home Country, the Client believes that he or she did not receive the service and support he or she expected from the Let's Go OC, the Let's Go OC, will refund an appropriately proportional percentage of the cost of the Client’s tour. If the Parties cannot agree on appropriately proportional percentage, they shall submit their dispute to Arbitration as set forth below.

19. CLAIMS & COMPLAINTS
If you have a complaint about your trip please inform your tour leader or our local representative at the time in order that the they can attempt to rectify the matter. If satisfaction is not reached through these means then any further complaint should be put in writing to us within 30 days of the end of the tour.

20. ARBITRATION
Any controversy or claim arising out of or relating in any way to this Agreement will be subject to Arbitration in the State of Florida. A separate Arbitration Agreement will be executed by the Parties simultaneously with this Agreement.

21. ENTIRE AGREEMENT
The foregoing contains the entire agreement between the parties, and there are no other understandings or agreements (other than the Arbitration Agreement) between them.

I CERTIFY THAT I HAVE READ, FULLY UNDERSTAND AND ACCEPT ALL TERMS & CONDITIONS
